Etologia, primatologia e direito: fundamentos interdisciplinares para a aplicação do habeas corpus aos grandes primatas

Abstract

The present study proposes an interdisciplinary analysis between Law, Ethology, and Primatology, with the aim of expanding the theoretical foundations that support the use of habeas corpus as an instrument to guarantee the fundamental right to freedom of non-human animals, especially great apes. Based on the scientific recognition of animal sentience, the text seeks to demonstrate that cognitive and social behaviors traditionally attributed exclusively to human beings are also present in these animals, thereby reinforcing their moral and legal relevance. From this perspective, the study aims to consolidate arguments capable of justifying the legal protection of the freedom of movement of great apes through the constitutional remedy of habeas corpus, contributing to the strengthening of Animal Law and to the construction of a new legal paradigm grounded in interdisciplinarity.
