A QUESTÃO CULTURAL COMPARATIVA NAS MEDIAÇÕES DE CONFLITOS NO BRASIL E NA ITÁLIA
Abstract
This article analyzes conflict mediation in the extrajudicial sphere, focusing on the role of notarial services in Brazil and Italy. Through a comparative cultural approach, the study explores how cultural factors influence the acceptance, practice, and effectiveness of mediation in each country. In Italy, the legal culture has historically favored alternative dispute resolution mechanisms, with mediation being widely institutionalized and, in some cases, mandatory. In contrast, Brazil is still in the process of consolidating mediation, which faces sociocultura
l resistance despite recent legislative progress, such as the Mediation Law (Law No. 13,140/2015). Brazilian notaries still face challenges in implementing mediation broadly and effectively. This article seeks to understand how cultural, historical, and institutional differences shape mediation experiences in both countries, highlighting the transformative potential of a culture of peace through the strengthening of extrajudicial mediation.
